Terms and conditions of RadOne UG (haftungsbeschränkt) for workshop services and test rides
This is a translation. Only the German version is legally binding.
Part A – General
- Scope (§ 1). These terms apply to workshop jobs and test rides with RadOne UG (haftungsbeschränkt), Schlegelstraße 32, 10115 Berlin, HRB 307951 (Munich local court), managing director Kristjan Maruste, VAT ID DE457309604, +49 151 23935665, berlin@radone.de. Individual agreements take priority. Sales of bikes and parts have separate terms.
- Prices and payment (§ 2). Prices as stated at booking or on the job, otherwise our current price list; consumer prices include 19 % VAT. Package prices are fixed for the described scope; parts are extra unless included. Payment is due at pickup by card or bank transfer (a transfer can also be made before pickup); we do not accept cash. With a transfer the bike is released once the money has arrived.
- Our liability (§ 3). Unlimited for intent, gross negligence, injury to life, body or health, product liability and guarantees. For slight negligence only for breach of essential contractual duties, limited to the foreseeable, typical damage.
- Privacy (§ 4): see our privacy policy. Disputes (§ 5): we do not take part in consumer arbitration. Law (§ 6): German law, CISG excluded; consumers keep the mandatory protection of their home country.
Part B – Workshop service
- Booking (§ 7). An online, phone, email or chat booking reserves a drop-off slot; it is not yet a binding order. The order is made when you drop the bike off and we accept it. You can cancel or move a reservation free of charge.
- Drop-off (§ 8). Bring battery and keys where needed; take bags and valuables with you. Tell us about known damage, accidents, modifications and tuning; we may refuse to work on tuned e-bikes.
- Scope and extra work (§ 9). We only do work beyond the agreed scope after your yes, with the price stated first. A written estimate is non-binding unless marked binding; we ask before exceeding it by more than 15 %. If you decline the repair after a diagnosis, the diagnosis is charged (e-bike electrics €75, otherwise 30 minutes' labour), as told to you beforehand.
- Parts (§ 10). New parts of original or equivalent quality; used parts only with your consent. Old parts are disposed of unless you ask for them at drop-off; warranty parts stay with us.
- Completion (§ 11). Completion dates are estimates unless expressly guaranteed (e.g. same-day express). We message you when the bike is ready.
- Leasing / JobRad (§ 12). Covered work is billed to the leasing company. Work it does not cover is yours to pay, only with your prior consent. If the leasing company refuses payment because details were wrong or the work isn't covered, you pay the price we quoted.
- Manufacturer warranty (§ 13). The manufacturer (e.g. VanMoof, Clayton) decides on warranty. If it refuses, we repair only with your consent and for payment.
- Pickup and storage (§ 14). Please collect within 14 days of our ready message; after that we charge €5 per day storage.
- Lien (§ 15). The bike is released after payment; we have a statutory workshop lien (§ 647 BGB). If a bike is not collected or paid for 3 months after our ready message, we write to you with a final one-month deadline and may then sell it under the statutory rules, paying out any surplus.
- Acceptance and warranty (§ 16). Taking the bike counts as acceptance; hidden defects can be claimed later. Statutory rights apply; limitation period two years from acceptance (one year for businesses). Normal wear, accidents and later work by others are not defects.
Part C – Test rides
- Service (§ 17). We lend you a demo bike free of charge for about 30 minutes, after a short introduction. Cancelling or moving is free. No obligation to buy.
- Requirements (§ 18). 18+, fit to ride, not impaired by alcohol, drugs or medication, valid photo ID shown (we only note its type), test ride agreement signed.
- Your duties (§ 19). Only you ride; no passengers, heavy loads, off-road, racing or jumps; follow traffic rules; always lock the bike when parked; return it on time; call us at once after an accident, damage or theft and report theft or accidents involving others to the police.
- Liability (§ 20). You are liable for damage to or loss of the bike only if caused intentionally or by gross negligence (e.g. left unlocked, riding impaired, letting someone else ride). Not for slight negligence. Damage to others: statutory rules.
- After the ride (§ 21). We send a thank-you message. Further offers only with your express consent, which you can withdraw at any time.
